Terms and Conditions

These Terms govern the use of Data Quay Solutions Ltd.'s websites, customer portals, online payment facilities and services, including services available through dataquay.org and travel.dataquay.org.

By purchasing a service, making a payment, creating an account, accepting a quotation or entering into a service or travel agreement with Data Quay Solutions Ltd. (“Data Quay”, “we”, “us” or “our”), you agree to these Terms and Conditions together with any service-specific agreement, quotation, itinerary, payment plan or booking terms provided to you.

1. About Data Quay

Data Quay Solutions Ltd. is a company operating from Antigua and Barbuda.

Data Quay provides services which may include:

  • software and technology services;
  • travel planning and coordination;
  • group travel arrangements;
  • accommodation and transportation arrangements;
  • cruise and airline booking coordination;
  • travel documentation and administrative assistance;
  • visa application assistance and related administrative services;
  • travel insurance facilitation where offered;
  • payment-plan administration; and
  • other services described on our websites, quotations, invoices or agreements.

Certain travel products and services are supplied by independent third parties, including airlines, cruise lines, hotels, tour operators, insurers and transportation providers.

2. Travel Services and Third-Party Suppliers

Where Data Quay arranges or facilitates a service provided by a third-party supplier, that supplier may impose its own terms, conditions, fare rules, cancellation provisions and refund restrictions.

By confirming a booking, you agree to comply with applicable supplier terms in addition to Data Quay's terms.

Data Quay is not responsible for acts, omissions, schedule changes, cancellations, delays or service failures of independent suppliers except to the extent that liability arises directly from Data Quay's own obligations or as otherwise required by applicable law.

3. Prices and Currency

The applicable transaction currency will be clearly displayed before payment. Prices may be stated in:

  • Eastern Caribbean Dollars (XCD);
  • United States Dollars (USD); or
  • another currency expressly identified for the transaction.

A dollar symbol displayed without further context should not be relied upon to determine currency. The currency stated on the invoice, quotation, checkout page or payment confirmation governs the transaction.

Your card issuer or financial institution may impose currency conversion charges, foreign transaction fees or other charges. Such charges are separate from amounts charged by Data Quay.

4. Quotations and Prices

Unless otherwise stated, quotations are subject to availability and may change before booking or confirmation.

Travel prices may change because of airfare, accommodation rates, cruise fares, taxes, government charges, exchange rates, supplier pricing or availability.

A price is not guaranteed until Data Quay confirms the booking or otherwise confirms that the applicable price has been secured.

5. Deposits and Payment Plans

Certain services may permit deposits or instalment payment arrangements. Where a payment plan applies:

  • the customer remains responsible for the full amount due under the applicable agreement;
  • payments must be made according to the agreed schedule;
  • paying an instalment does not necessarily mean that the corresponding amount remains refundable;
  • supplier commitments may be made using payments received;
  • late or missed payments may affect bookings or services; and
  • any interest, financing charge, late charge or other payment-plan term must be disclosed in the customer's agreement or payment schedule.

The customer's individual agreement and payment schedule will govern where they contain terms specific to that transaction.

6. Online Payments

Online card payments may be processed through an authorised third-party payment gateway and Data Quay's acquiring financial institution.

Before confirming a payment, customers will be shown the amount and applicable transaction currency.

A payment is not considered successfully completed merely because a payment attempt has been initiated. Confirmation is subject to successful authorisation and processing.

Data Quay may maintain transaction references and payment status information for accounting, reconciliation, fraud prevention and customer-service purposes.

7. Invoices and Receipts

Customers may receive invoices, statements and receipts electronically.

Travel customers may also have access to invoices, balances, payment schedules and transaction histories through the Data Quay Travel Portal.

Customers should review receipts and notify Data Quay promptly if they believe a payment has been incorrectly recorded.

8. Cancellations and Refunds

Cancellations and refunds are governed by Data Quay's applicable Cancellation and Refund Policy, the customer's individual agreement and any applicable third-party supplier terms.

Some payments may become partially or entirely non-refundable once funds have been committed to a third-party supplier or once a non-refundable service has been performed.

Nothing in these Terms removes any right that cannot lawfully be excluded.

9. Visa and Immigration Assistance

Where Data Quay provides visa, immigration or travel-document assistance, Data Quay assists with the administrative process but does not make immigration decisions.

Visas, entry permissions and immigration decisions are determined by the relevant government, embassy, consulate, immigration authority or other competent authority.

Unless expressly guaranteed by the relevant authority, payment for assistance does not guarantee:

  • approval of a visa;
  • issuance by a particular date;
  • admission to a country; or
  • any particular immigration outcome.

Government, embassy, biometric, application and similar third-party fees may be non-refundable after submission or payment to the relevant authority.

10. Customer Responsibilities

Customers are responsible for:

  • providing accurate personal and contact information;
  • checking names, dates and travel details before booking;
  • maintaining valid passports and other travel documents;
  • satisfying immigration, visa, health and entry requirements;
  • providing requested documents within applicable deadlines;
  • reviewing invoices and payment schedules; and
  • notifying Data Quay promptly of relevant changes.

Customers are responsible for consequences resulting from materially incorrect information they provide, subject to applicable law.

11. Electronic Communications

Customers consent to receiving service-related communications electronically, including invoices, receipts, booking information, payment reminders, travel documentation and account notices.

12. Intellectual Property

Unless otherwise stated, content, branding, software, graphics and materials created and owned by Data Quay remain the property of Data Quay Solutions Ltd.

Third-party names, logos and trademarks remain the property of their respective owners.

13. Website and Portal Availability

We endeavour to maintain reliable access to our websites and customer portals but cannot guarantee uninterrupted availability.

Temporary outages, maintenance, telecommunications failures or third-party service interruptions may occur.

Customers experiencing payment uncertainty should contact Data Quay rather than repeatedly submitting a transaction.

14. Limitation of Liability

To the extent permitted by applicable law, Data Quay is not responsible for indirect losses resulting from events outside its reasonable control, including supplier cancellations, airline disruptions, government actions, natural disasters or telecommunications failures.

Nothing in these Terms excludes or limits liability where exclusion or limitation would be prohibited by law.

15. Governing Law

These Terms are governed by the laws of Antigua and Barbuda.

Any dispute shall be subject to the applicable jurisdiction and dispute-resolution procedures of Antigua and Barbuda unless another jurisdiction is required by applicable law.
